Premarital agreements in Nebraska are governed by the Uniform Premarital Agreement Act. Most importantly, a premarital agreement by definition is a contract entered into by prospective spouses in contemplation of marriage, to be effective upon marriage. Nebraska law does not allow postnuptial agreements unless such agreements are concurrent with a separation or divorce.

By executing a premarital agreement, the couple is able to agree in advance how certain aspects of their financial relationship will untangle in the event of divorce. By setting out these terms early on, in a time of amicable relations, the parties can define each person’s expectations in the event of marital discord. Premarital agreements also allow the parties to discuss and preserve their individual estate planning goals and plans in the event of one or both parties’ death.
